Terms of Service

These Terms of Service (“Terms”) govern your use of Cellar, the marketing site at https://cellar.fm, related download services, the Cellar applications for macOS, Windows, Linux, Android, and iOS, and optional tips.

1. The product

Cellar is an independent client for YouTube Music on macOS, Windows, Linux, Android, and iOS. It is not affiliated with, or endorsed by, YouTube or Google. You need your own YouTube Music / Google account to use Cellar. Cellar is free to use. There is no license key and no subscription for Cellar itself. The iOS and Android apps are in a pre-release beta that is available early to supporters on Patreon; see section 6.

2. Eligibility

You must have legal capacity to enter into a binding contract. Where you are an EU consumer, mandatory consumer rights prevail over conflicting terms to the extent required by law.

3. Google / YouTube relationship

Cellar does not replace your Google account. You must comply with Google’s and YouTube’s terms when using their services through Cellar. We are not responsible for Google or YouTube outages, policy changes, or account actions taken by Google.

4. Use of Cellar

• You may download Cellar from https://github.com/timlangner/cellar/releases/latest, or from Google Play where we offer it, and use it on as many of your own devices as you like. The pre-release mobile builds are distributed as described in section 6.
• You receive a personal, non-exclusive, non-transferable right to use Cellar. You may not resell Cellar, claim affiliation with YouTube or Google, or use Cellar in violation of applicable law or third-party intellectual property rights.
• We may provide updates at our discretion while we maintain the product. We do not promise perpetual compatibility with YouTube Music APIs or services.

5. Optional tips

You may optionally support Cellar (for example by buying a coffee). Tips are voluntary. They help development and cover server costs. They are not required to download, install, or use Cellar. A tip does not unlock a feature, a license or early access; early access to the pre-release mobile apps comes only through Patreon (section 6).

Tip checkout is handled by Ko-fi at https://ko-fi.com/cellarfm. Ko-fi’s own terms and privacy policy apply to that checkout. Tips are treated as voluntary and freely given. If something went wrong with a tip, email support@cellar.fm.

6. Early access beta for the mobile apps (Patreon)

Draft. This section is a draft and is subject to change before the early access beta begins.

• What it is. Cellar itself is free and the mobile apps will be made public later, on a date that is not set. Until then, supporters on Patreon get early access to pre-release builds of the iOS and Android apps. Your Patreon support is voluntary support for development. The early access is a thank-you, not the sale of a license, and the mobile apps do not need a paid license once they are public.
• Pre-release software. Beta builds can be unstable, change or lose features, and be withdrawn. Data stored on our server for the beta, such as listening history, resume points, pins and Release Radar, and data stored in the app, may be reset or deleted without notice. Do not rely on Cellar as a backup of anything.
• No guarantee of availability or duration. We do not promise a release date, a feature, or how long early access lasts. We may pause, change or end early access, and we may stop old builds from working, for example by requiring an update.
• Patron-only files. The beta builds are for supporters. Do not share, upload or resell them.
• Google account risk. Cellar is unofficial and using it may go against YouTube’s terms. To play music it sends your YouTube Music session to our server, which uses it to request streams from Germany through Cloudflare. Google may flag sessions it sees from another country, ask you to verify, restrict or suspend your account, and some content may follow the German catalog. You use the beta at your own risk and we are not liable for actions Google takes. We recommend a secondary Google account.
• Cancelling. If you cancel or your pledge lapses, you stop receiving new builds. A build you already have keeps working until it is retired. We may retire a build at any time and will use a required update for that.
• Payments and refunds. Pledges are billed by Patreon under Patreon’s terms, including its refund rules; we do not hold your payment details. Where mandatory consumer law gives you a right to withdraw or to a refund, it stays unaffected. Beyond that we do not promise refunds for months already billed.

7. Taxes

The operator is a small business under German Kleinunternehmen § 19 UStG.

8. Acceptable use

You may not abuse the Services, attempt unauthorized access, or use Cellar in violation of applicable law or third-party intellectual property rights.

9. Intellectual property

We own the Cellar software, branding, and site content (except third-party materials). YouTube, Google, and related marks belong to their respective owners.

10. Disclaimer

To the maximum extent permitted by law, the Services are provided as is. Mandatory consumer warranties remain unaffected.

11. Liability

• Liability is unlimited for intent, gross negligence, injury to life, body, or health, and under the German Product Liability Act (ProdHaftG).
• For slight negligence, we are liable only for breach of essential contractual duties, and then limited to foreseeable, typical damage.
• We are not liable for Google / YouTube outages or account actions outside our control.
• Mandatory consumer rights remain unaffected. For business customers, the exclusive venue is Nordhorn, Germany, where permitted.

13. Suspension and termination

We may suspend or terminate access for material breach of these Terms. You may stop using Cellar at any time.

14. Changes

We may update these Terms by posting a revised version with a new “Last updated” date.

15. Governing law and disputes

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). EU consumers keep mandatory protections of their country of residence. The European Commission’s Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. We are not obliged to participate in a consumer arbitration board (Verbraucherschlichtung).

16. Severability and entire agreement

If a provision is invalid, the remaining Terms continue in effect. These Terms, together with the linked policies and the checkout terms of Ko-fi (tips) and Patreon (early access), form the entire agreement regarding the Services.
